After guest has checked out and the property has been inspected and cleaned, t additional fees may be deducted from the damage deposit or included in a damage claim. Guest agrees to be held responsible for all extra charges in the case where damages or costs incurred are in excess of the damage deposit. 6 Rental Period The rental period begins on the check-in date at 4:00 PM and ends on the check-out date at 10:00 AM. Any modified rental period dates or times must be coordinated through the OTA reservation. Guest agrees to these same terms for any rental period modifications. It is important to check-out at the correct time so that housekeeping can inspect, clean and setup the property for the next guest. The Guest agrees to leave the property at the check-out time. By accepting this reservation, it is agreed that all guests are expressly assuming the risk of any harm arising from their use of the property. 8 Insurance Guest should consider purchasing trip insurance (traveler insurance) as no refunds will be given for storms, hurricane evacuation or other inclement weather. 9 Homeowner/Host Right to Enter The Guest shall allow the Homeowner and their agents (including, but not limited to housekeeping, repair personnel, pest control, inspection and resort personnel) to access the property. The Homeowner shall exercise this right of access in a reasonable manner and attempt to notify the Guest prior to access. 10 Illegal Activity Guest shall not perform any illegal activity while residing in the property. Guest shall not manufacture, use or abuse any illegal drugs while in the property. Homeowner is not responsible for Guest making the reservation under false pretenses or engaging in criminal behavior during the stay in the property. 11 House Parties House parties are strictly prohibited. Any loud, rowdy or disruptive behavior is strictly prohibited. Any violation of this rule will result in immediate eviction/ejection of the Guest and the members of the rental group by the resort property without refund or return of deposit. If eviction/ejection becomes necessary, Guest agrees to pay for any legal fees that Homeowner or resort property incurs as well as a $250.00 processing fee. 12 Smoking Policy The Guest understands that this is a non-smoking and non-vaping property. No smoking is allowed inside or on the balcony at any time by the guest, the rental group or any other persons in the property. The Guest agrees to pay an additional cleaning fee of $250.00 if the Guest or any members of the rental group smokes inside or on the property balcony. 13 Unregistered Guests People other than the registered Guest, the rental group and agents of the Homeowner are not allowed in the property. 14 Cancellation Policy The cancellation policy is defined in the OTA reservation. The Guest agrees that all rental monies are non-refundable per cancellation policy. Homeowner has the right to cancel the Guest’s stay or evict/eject Guest from the property if the Guest breaks this agreement. 15 Proper Use of Furnishings Guest is responsible for keeping the unit and its furnishings reasonably clean, neat and in good order. Guest agrees to use all furnishings, appliances, air conditioning and plumbing facilities in the recommended manner. Members of rental group will not flush anything other than toilet paper in the toilets. If exterior doors are left open, the A/C will freeze over due to excess humidity and it will not work at all. This may damage the A/C unit, and Guests will be hot. It is recommended that ceiling fans be used for additional cooling. Guest agrees to be responsible and pay for any and all repair costs due to misuse. 16 Wristbands Laketown Wharf Resort requires that all guests wear resort wristbands while on the property. Prior to check-in, Guest will receive a link to a reservation system which enables Guest to pay the Resort Fee at a discounted rate. Registering at Check-in may incur a higher Resort Fee. No refunds will be given if any resort amenity is closed for maintenance, enhancements or other reasons during the stay. Resort wristbands must be left in the unit at the end of the stay. A maximum of a $100 fee per lost wristband will be passed along to Guest to reimburse Host for fees charged by Laketown Wharf Resort Community Association and/or Housekeeping team. 17 Parking Parking is limited to 2 vehicles for this reservation and permits are provided by the resort. Vehicles are to be parked as designated by the resort. Any illegally parked vehicles are subject to towing; applicable fines and towing fees are the sole responsibility of the vehicle owner. Campers, golf carts and other recreational vehicles are not allowed on the resort property. 18 Housekeeping There is no housekeeping service provided during the rental period. While linens and bath towels are included in the unit, daily maid service is not included. Guest will not take towels or linens away from the premises, excluding beach towels provided for use during Guest stay. Starter supplies are provided including toilet paper, but may not be enough for the entire rental group for the entire reservation period. Guests are responsible for purchasing all additional supplies for the rental group. The property is inspected and cleaned at the end of each stay. If the property appears dirty or damaged upon Check-in, Guest shall inform Homeowner immediately by calling, texting or messaging through OTA. After the check-out inspection, any repair or replacement cost for damages will be deducted from the deposit or included in a damage claim. Excessive damage will incur additional charges. If the property requires excessive cleaning beyond normal, there will be an additional cleaning fee charged to Guest. Do not move any cable or electronic equipment, you will be charged a reconnect fee. 19 Entrance The unit has an electronic door lock, and Guest will be sent a message with the door code for the stay. The door code will be only active from Check-in time to check-out time. The door lock will not be reprogrammed for a late Check-out. A Ring security camera is mounted on the front door to help ensure safety. Guest agrees to the use of the door camera and audio/video recordings for the overall safety of the property and guests. 20 Severability If any provision of this Agreement is held illegal or unenforceable in a judicial proceeding, such provision shall be severed and shall be inoperative and, provided that the fundamental terms and conditions of this Agreement (including any indispensable provisions) remain legal and enforceable, the remainder of this Agreement shall remain operative and binding on the Parties. 21 Resort Rules The Rules and Regulations of the Laketown Wharf Resort Community Association apply to both owners and guests. Some rules, if not followed, may result in a fine to the homeowner. Any fine that is attributable to a Guest will be passed along to the Guest. Fines that may be passed along to a Guest include, but are not limited to, unregistered animals, missing resort wristbands, parking violations, pool and hot tub violations, fitness center violations, balcony violations, trash left outside the door and improper use of trash chutes or dumpsters. Due to the fine approval process, a fine may be imposed after the Guest’s deposit is returned or claim period expires. Guest agrees to reimburse Homeowner within 14 days of notification of any fine imposed. 22 House Rules Guest agrees to abide by, and ensure that all members of the rental group and anyone else abide by, the following House Rules at all times while in the property: 1. The primary Guest must be 25 years of age or older, must be staying in the property and must be present at check-in 2. Maximum occupancy of the property is 7; All guests must be registered and wear the provided wristband during their entire stay 3. No parties or events are permitted 4. Kegs and funnels are not permitted 5. No smoking or vaping is permitted inside or on the balcony 6. Guests shall not leave any minor alone or unsupervised in the property. 7. No illegal activities or misconduct 8. No spitting, throwing, leaning over or hanging on the balcony railing (including towels) 9. Keep the thermostat in range (A/C 70-78 degrees and Heat 68 degrees or lower). 10. Keep sliding doors closed 11. No pets; Guest will be asked to leave the property immediately without refund 12. Tampering with security devices or locked cabinets is a felony and will be prosecuted 13. Noise must remain at a reasonable level, following resort guidelines 14.
