Guests wishing to extend their stay may do so by contacting the Manager and paying additional fees if the unit is available for extension and the guest has abided by all rules. USE OF PREMISES/ABSENCES. Guest shall occupy and use the Premises as a dwelling unit. Guest shall notify Manager of any anticipated extended absence from the Premises not later than the first day of the extended absence. Guest will maintain the premises in good order and appearance including keeping the premises free of trash and garbage. Reasonable wear and tear are the only exceptions to damage to the premises. Booking guest agrees to be the primary occupant of the dwelling during the entire period of the rental. Guest may not use the premise for commercial or event purposes. No commercial photography or filming is allowed on the property. Guests booking units that may allow small weddings or similar must notify Manager upon booking, pay additional fees and disclose all requested information to Manager. In the event a guest hosts an agreed up event but does not give accurate information as to the time of the event, number of guests or type of event, booking will be cancelled and guests immediately evicted. Any agreed upon event must be paid no less than 7 days prior to event. Manager has the right to deny any event request for any reason. Guests may not hang towels over outdoor railings, erect tents or banners or do anything else to make property look less appealing to neighbors. Guest agrees to lock all doors and windows when they are not at the property. Due to the COVID-19 pandemic, Guest agrees to adhere to all guidance from the Centers of Disease Control and Prevention (CDC) on COVID-19 and any local and state regulations. Local and state regulations can be found on the local public health department website. OCCUPANTS. No more than the number of person(s) entered in the booking may occupy the Premises at any one time unless the prior written consent of the Manager is obtained. All guests over the age of 2 are counted towards the maximum. Any party falsely representing the number of people, or exceeding the maximum may be subject to immediate eviction without refund. All guests over the age of 15 will be required to provide a copy of a government issued ID. For properties that allow pets, pets are only allowed if approved by Manager. All pets must be disclosed to Manager within 24 hours of booking, or if booking is less than 24 hours from booking time then at the time of booking. Guest must pay any required pet fees no less than 7 days prior to reservation start. For bookings made within a week of reservation, fee must be paid same day as the reservation is made. Guests must be 25 to book (or the specified minimum age to book as noted on the booking site). Guests under the minimum age must be accompanied by a legal guardian or parent. Guests over 25 may not book a property for the use of a group under the age of 25 (ex: a mom or aunt cannot book a unit for a group of high schoolers where the parent or legal guardian will not be present). FURNISHINGS. The unit is completely furnished and stocked. Guest shall return all such items at the end of the stay in a condition as good as existed at the beginning of the booking, normal wear and tear excepted. PROPERTY INSURANCE. Manager and Guest shall each be responsible to maintain appropriate insurance for their respective interests in the Premises and property located on the Premises. Guest shall also maintain any other insurance which Manager may reasonably require for the protection of Manager's interest in the Premises. Guest is responsible for maintaining casualty insurance on its own property. It is recommended that travel or vacation insurance is obtained by the Guest. Manager requires unit insurance coverage purchase at booking. NON-DISTURBANCE CLAUSE. Guest and their guests shall not disturb, annoy, endanger (fireworks) or inconvenience neighbors nor use the premises for any unlawful purposes. Quiet hours are from 10pm to 8am. Guests shall adhere to noise policy and shall interact kindly with neighbors. Guests understand that many units are in residential areas and will act with the utmost respect while at the premise or in the neighborhood/condo. Guest will not be heard using foul language, being rude, arguing or displaying obvious intoxication. Guest will treat property with the same care as if the property was their home and will not hinder normal traffic patterns in the area. Guests will not do anything neither at the unit nor in the neighborhood/building that would cause complaints from neighbors, HOA or Condo Managers or police/code enforcement. Guest will abide by any parking restrictions. CANCELLATIONS. (a) If the Property becomes unavailable to the Guest prior to occupancy, for any reason, Manager agrees to refund the full amount paid to the date of cancellation, and Guest agrees to rebooking any claims against Manager. (b) Cancellations from guest will be refunded as described on the booking site used by guest. Guest understands that use of OTA’s such as Airbnb frequently require the guest contact the OTA directly as sites like Airbnb hold the guests money and Manager may not have ability to refund. Cancellations related to the COVID-19 pandemic are dependent on a number of factors including: local restrictions, origin of the guest, when the booking was made, and when local officials or the CDC declare an outbreak in an area. If the cancellation is related to COVID-19, please refer to the booking sites policy. SMOKING. Smoking is strictly forbidden inside the Property. Smoking is only allowed "outside". Evidence of smoking inside the Property will result in immediate eviction and forfeiture of all amounts paid and will result in additional Cleaning Fee charges to Guest as Excess Damage Cost and will be charged against the credit card on file. Smoking near open doors and windows that leads to interior smell of smoke will be charged as if guest was smoking in unit. Please note, purchased damage coverage does not cover smoking and guests card on file will be charged $500 for damage and smoke remediation. COOKING. Guest may cook only in the specific areas set aside by Manager for cooking. No open fires are allowed other than in the grill, outdoor fireplace, or in the stone hearth. The grill must remain in open area, away from trees, house, etc. All fires must be thoroughly extinguished before leaving unattended. CLEANING. The property will be inspected and cleaned after departure. Due to the pandemic, the property will augment current cleaning protocol to account for the changes in cleaning in adherence to COVID-19 cleaning protocols. The cleaning fee includes laundry service for the towels and linens. Guest is required to leave the property in the same general condition that it was received in by making sure that the dishes are washed and put away, and the house is generally picked up and ready to be vacuumed, dusted, disinfected and laundered. The property has been cleaned in accordance with WHO and CDC recommended cleaning and disinfecting standards. HOT TUBS & POOLS. For properties with a Hot Tub or Pool, guest acknowledges, and is fully aware that the hot tub and/or pool can be dangerous and slippery. Injury can be caused by careless acts. The undersigned Guest and their visitors accepts and assumes all risks involved in or related to the use of the hot tub and/or pool. No lifeguard on duty pool. Guest will be required to never swim alone and children will always be supervised. Nobody that is unable to swim shall enter the pool or hot tub. No diapers or similar allowed in pool. No glass or food in pool. Glass or food in pool would result in an extra pool cleaning charge to guest. HOLDOVER. If Guest maintains possession of the Premises for any period after the termination of this Booking ("Holdover Period”), Guest shall pay to Manager booking payment(s) during the Holdover Period at a rate equal to the most recent highest-posted rate preceding the Holdover Period. Such holdover shall constitute a month-to-month extension of this Booking. Guest are required to prepay and get reapproval to holdover. CUMULATIVE RIGHTS. The rights of the parties under this Booking are cumulative, and shall not be construed as exclusive unless otherwise required by law. ACCESS BY Manager TO PREMISES. Subject to Guest's consent (which shall not be unreasonably withheld), Manager shall have the right to enter the Premises to make inspections, provide necessary services, or show the unit to prospective buyers, mortgagees, Guests or workers. However, Manager does not assume any liability for the care or supervision of the Premises while under the possession and of Guest. As provided by law, in the case of an emergency, Manager may enter the Premises without Guest's consent. During this Booking, Manager shall be allowed to display the usual "To Let" signs and show the Premises to prospective Guests. INDEMNITY REGARDING USE OF PREMISES. To the extent permitted by law, Guest agrees to indemnify, hold harmless, and defend Manager from and against any and all losses, claims, liabilities, and expenses, including reasonable attorney fees, if any, which Manager may suffer or incur in connection with Guest's possession, use or misuse of the Premises, except Manager's act or negligence. DANGEROUS MATERIALS. Guest shall not keep or have on the Premises any article or thing of a dangerous, flammable, or explosive character that might substantially increase the danger of fire on the Premises, or that might be considered hazardous by a responsible insurance company, unless the prior written consent of Manager is obtained and proof of adequate insurance protection is provided by Guest to Manager. COMPLIANCE WITH REGULATIONS. Guest shall promptly comply with all laws, ordinances, requirements and regulations of the federal, state, county, municipal and other authorities, and the fire insurance underwriters. However, Guest shall not by this provision be required to make alterations to the exterior of the building or alterations of a structural nature. ASSIGNABILITY/SUBLETTING. Guest may not assign or subbooking any interest in the Premises, nor assign, mortgage or pledge this Booking, without the prior written consent of Manager. CASUALTY OR DESTRUCTION. (a) Should the Property be destroyed or rendered uninhabitable by an Act of God (including, but not limited to, hurricanes, storms, floods or fires), or by environmental disaster, or loss of utilities prior to occupancy by Guest, this Agreement shall become null and void, and all payments made hereunder shall be refunded to Guest. (b) Should the Property be destroyed or rendered uninhabitable as above during occupancy, reimbursement on a pro-rated basis will be negotiated between Guest and Manager based on the following: No refund is due (or will be made) for inclement weather. NOTICE. Notices under this Booking shall not be deemed valid unless given or served in writing and forwarded by mail, postage prepaid, addressed to the party at the appropriate address set forth below. Such addresses may be changed from time to time by either party by providing notice as set forth below. Notices mailed in accordance with these provisions shall be deemed received on the third day after posting. Such addresses may be changed from time to time by either party by providing notice as set forth above. GOVERNING LAW. This Booking shall be construed in accordance with the laws of the State of Florida. ENTIRE AGREEMENT/AMENDMENT. This Booking contains the entire agreement of the parties and there are no other promises, conditions, understandings or other agreements, whether oral or written, relating to the subject matter of this Booking. This Booking may be modified or amended in writing, if the writing is signed by the party obligated under the amendment. SEVERABILITY. If any portion of this Booking shall be held to be invalid or unenforceable for any reason, the remaining provisions shall continue to be valid and enforceable. If a court finds that any provision of this Booking is invalid or unenforceable, but that by limiting such provision it would become valid and enforceable, then such provision shall be deemed to be written, construed, and enforced as so limited. WAIVER. The failure of either party to enforce any provisions of this Booking shall not be construed as a waiver or limitation of that party's right to subsequently enforce and compel strict compliance with every provision of this Booking. BINDING EFFECT. The provisions of this Booking shall be binding upon and inure to the benefit of both parties and their respective legal representatives, successors and assigns. DISPUTE RESOLUTION. The parties will attempt to resolve any dispute arising out of or relating to this Agreement through friendly negotiations amongst the parties. If the matter is not resolved by negotiation, the parties will resolve the dispute using the below Alternative Dispute Resolution (ADR) procedure. Any controversies or disputes arising out of or relating to this Agreement will be submitted to mediation in accordance with any statutory rules of mediation. If mediation is not successful in resolving the entire dispute or is unavailable, any outstanding issues will be submitted to final and binding arbitration under the rules of the American Arbitration Association. The arbitrator's award will be final, and judgment may be entered upon it by any court having proper jurisdiction. CAUSE FOR EVICTION. The Guest and all parties with the Guest will be subject to immediate eviction from the Property if the Guest or parties of the Guest violate any terms of this Agreement, including but not limited to, violation of the occupancy limits, pet provision, smoking, noise ordinance or parking. In the event of eviction from the Property, the Guest shall forfeit all amounts paid and there will be no refund of money. ATTORNEY'S FEES AND COSTS. If Manager employs the services of an attorney to enforce any conditions of this Agreement, to collect any amounts due, the eviction of the Guest, or because Guest takes any action to recover deposits not due, Guest shall be liable to Manager for reasonable attorney's fees and costs incurred by Manager. D. Renter must be at least 21 years of age (or the specified minimum age required to rent the property, if different). Guests under the minimum age must be accompanied by a parent or legal guardian.

We are only an 80-minutes from the Orlando theme parks (Disney, Universal, & Sea World), 75-minutes to Kennedy Space Center, and only 1-hour to St. Augustine, the nations' oldest city. Ocean Vistas is perfectly located to enjoy all that Central Florida has to offer. Guest access Guests have fob access to garage gates and security doors. Guests are permitted in common areas and may use all building amenities. Oceans Vistas amenities include club room with pool table, sun deck, pool, hot tub, fire pit, & fitness center with sauna and bathroom. An ice machine can be accessed from the club room. Guests have access to drive on the beach for a fee or use our boardwalk, both off of the south garage entrance. Room access is by physical key and front doors lock automatically. There is 1-front door key and 1-access fob issued per bedroom. Other things to note A starter kit of household essentials is provided, including trash bags, laundry pods, dish detergent pods, toilet paper, and paper towels. Additional supplies are the guest’s responsibility. Guests have a central point of contact with Daytona Oceanfront Rentals and will also meet a host at check-in for a building tour prior to key transfer. Building management require a hosted check-in. A trusted host will reach out by SMS text prior to check-in to coordinate your arrival. Guests are responsible for prompt and courteous communication with the host. The check-in time is an appointment with the host and guests that miss their appointment may have a delay until a new host can be scheduled. Normal check-in is from 4:00PM to 8:00PM EST. Late check-in from 8:00PM-12:00AM EST will incur a $100 service fee payable in cash onsite to the host prior to key transfer. No check-in is allowed from 12:00AM-10:00AM EST. Guests are required to return a registration form providing mobile contact number (not the anonymous AirBNB number), home address, car model & license plate number and names of unit occupants. This information is filed with the respective building management office to provide to first responders in case of emergency. Guests must also provide this information to receive parking passes and to coordinate with the check-in host prior to arrival. All rates have been lowered to reflect the beach steps being closed. In the meantime, the nearest open beach access is just TWO houses away, so very close by! Please Note: For security, we do not include identifiable, exterior photos of the home. However, this home is truly oceanfront and includes all of the items on the oceanfront deck listed below. Guest shall be entitled to possession on the first day of the term of the booking at 3pm (condos) 4pm (houses), and shall yield possession to Manager on the last day of the term of this Booking at 10am, unless otherwise agreed by both parties in writing and early check-in or late check-out fee paid. At the expiration of the booking, guest shall remove its goods and effects and peaceably yield up the Premises to manager in as good a condition as when delivered to guest. MINIMUM STAY. The guest will be required to pay for the booked dates. Guests wishing to extend their stay may do so by contacting the Manager and paying additional fees if the unit is available for extension and the guest has abided by all rules. USE OF PREMISES/ABSENCES. Guest shall occupy and use the Premises as a dwelling unit. Guest shall notify Manager of any anticipated extended absence from the Premises not later than the first day of the extended absence. Guest will maintain the premises in good order and appearance including keeping the premises free of trash and garbage. Reasonable wear and tear are the only exceptions to damage to the premises. Booking guest agrees to be the primary occupant of the dwelling during the entire period of the rental. Guest may not use the premise for commercial or event purposes. No commercial photography or filming is allowed on the property. Guests booking units that may allow small weddings or similar must notify Manager upon booking, pay additional fees and disclose all requested information to Manager. In the event a guest hosts an agreed up event but does not give accurate information as to the time of the event, number of guests or type of event, booking will be cancelled and guests immediately evicted. Any agreed upon event must be paid no less than 7 days prior to event. Manager has the right to deny any event request for any reason. Guests may not hang towels over outdoor railings, erect tents or banners or do anything else to make property look less appealing to neighbors. Guest agrees to lock all doors and windows when they are not at the property. Due to the COVID-19 pandemic, Guest agrees to adhere to all guidance from the Centers of Disease Control and Prevention (CDC) on COVID-19 and any local and state regulations. Local and state regulations can be found on the local public health department website. OCCUPANTS. No more than the number of person(s) entered in the booking may occupy the Premises at any one time unless the prior written consent of the Manager is obtained. All guests over the age of 2 are counted towards the maximum. Any party falsely representing the number of people, or exceeding the maximum may be subject to immediate eviction without refund. All guests over the age of 15 will be required to provide a copy of a government issued ID. For properties that allow pets, pets are only allowed if approved by Manager. All pets must be disclosed to Manager within 24 hours of booking, or if booking is less than 24 hours from booking time then at the time of booking. Guest must pay any required pet fees no less than 7 days prior to reservation start. For bookings made within a week of reservation, fee must be paid same day as the reservation is made. Guests must be 25 to book (or the specified minimum age to book as noted on the booking site). Guests under the minimum age must be accompanied by a legal guardian or parent. Guests over 25 may not book a property for the use of a group under the age of 25 (ex: a mom or aunt cannot book a unit for a group of high schoolers where the parent or legal guardian will not be present). FURNISHINGS. The unit is completely furnished and stocked. Guest shall return all such items at the end of the stay in a condition as good as existed at the beginning of the booking, normal wear and tear excepted. PROPERTY INSURANCE. Manager and Guest shall each be responsible to maintain appropriate insurance for their respective interests in the Premises and property located on the Premises. Guest shall also maintain any other insurance which Manager may reasonably require for the protection of Manager's interest in the Premises. Guest is responsible for maintaining casualty insurance on its own property. It is recommended that travel or vacation insurance is obtained by the Guest. Manager requires unit insurance coverage purchase at booking. NON-DISTURBANCE CLAUSE. Guest and their guests shall not disturb, annoy, endanger (fireworks) or inconvenience neighbors nor use the premises for any unlawful purposes. Quiet hours are from 10pm to 8am. Guests shall adhere to noise policy and shall interact kindly with neighbors. Guests understand that many units are in residential areas and will act with the utmost respect while at the premise or in the neighborhood/condo. Guest will not be heard using foul language, being rude, arguing or displaying obvious intoxication. Guest will treat property with the same care as if the property was their home and will not hinder normal traffic patterns in the area. Guests will not do anything neither at the unit nor in the neighborhood/building that would cause complaints from neighbors, HOA or Condo Managers or police/code enforcement. Guest will abide by any parking restrictions. CANCELLATIONS. (a) If the Property becomes unavailable to the Guest prior to occupancy, for any reason, Manager agrees to refund the full amount paid to the date of cancellation, and Guest agrees to rebooking any claims against Manager. (b) Cancellations from guest will be refunded as described on the booking site used by guest. Guest understands that use of OTA’s such as Airbnb frequently require the guest contact the OTA directly as sites like Airbnb hold the guests money and Manager may not have ability to refund. Cancellations related to the COVID-19 pandemic are dependent on a number of factors including: local restrictions, origin of the guest, when the booking was made, and when local officials or the CDC declare an outbreak in an area. If the cancellation is related to COVID-19, please refer to the booking sites policy. SMOKING. Smoking is strictly forbidden inside the Property. Smoking is only allowed "outside". Evidence of smoking inside the Property will result in immediate eviction and forfeiture of all amounts paid and will result in additional Cleaning Fee charges to Guest as Excess Damage Cost and will be charged against the credit card on file. Smoking near open doors and windows that leads to interior smell of smoke will be charged as if guest was smoking in unit. Please note, purchased damage coverage does not cover smoking and guests card on file will be charged $500 for damage and smoke remediation. COOKING. Guest may cook only in the specific areas set aside by Manager for cooking. No open fires are allowed other than in the grill, outdoor fireplace, or in the stone hearth. The grill must remain in open area, away from trees, house, etc. All fires must be thoroughly extinguished before leaving unattended. CLEANING. The property will be inspected and cleaned after departure. Due to the pandemic, the property will augment current cleaning protocol to account for the changes in cleaning in adherence to COVID-19 cleaning protocols. The cleaning fee includes laundry service for the towels and linens. Guest is required to leave the property in the same general condition that it was received in by making sure that the dishes are washed and put away, and the house is generally picked up and ready to be vacuumed, dusted, disinfected and laundered. The property has been cleaned in accordance with WHO and CDC recommended cleaning and disinfecting standards. HOT TUBS & POOLS. For properties with a Hot Tub or Pool, guest acknowledges, and is fully aware that the hot tub and/or pool can be dangerous and slippery. Injury can be caused by careless acts. The undersigned Guest and their visitors accepts and assumes all risks involved in or related to the use of the hot tub and/or pool. No lifeguard on duty pool. Guest will be required to never swim alone and children will always be supervised. Nobody that is unable to swim shall enter the pool or hot tub. No diapers or similar allowed in pool. No glass or food in pool. Glass or food in pool would result in an extra pool cleaning charge to guest. HOLDOVER. If Guest maintains possession of the Premises for any period after the termination of this Booking ("Holdover Period”), Guest shall pay to Manager booking payment(s) during the Holdover Period at a rate equal to the most recent highest-posted rate preceding the Holdover Period. Such holdover shall constitute a month-to-month extension of this Booking. Guest are required to prepay and get reapproval to holdover. CUMULATIVE RIGHTS. The rights of the parties under this Booking are cumulative, and shall not be construed as exclusive unless otherwise required by law. ACCESS BY Manager TO PREMISES. Subject to Guest's consent (which shall not be unreasonably withheld), Manager shall have the right to enter the Premises to make inspections, provide necessary services, or show the unit to prospective buyers, mortgagees, Guests or workers. However, Manager does not assume any liability for the care or supervision of the Premises while under the possession and of Guest. As provided by law, in the case of an emergency, Manager may enter the Premises without Guest's consent. During this Booking, Manager shall be allowed to display the usual "To Let" signs and show the Premises to prospective Guests. INDEMNITY REGARDING USE OF PREMISES. To the extent permitted by law, Guest agrees to indemnify, hold harmless, and defend Manager from and against any and all losses, claims, liabilities, and expenses, including reasonable attorney fees, if any, which Manager may suffer or incur in connection with Guest's possession, use or misuse of the Premises, except Manager's act or negligence. DANGEROUS MATERIALS. Guest shall not keep or have on the Premises any article or thing of a dangerous, flammable, or explosive character that might substantially increase the danger of fire on the Premises, or that might be considered hazardous by a responsible insurance company, unless the prior written consent of Manager is obtained and proof of adequate insurance protection is provided by Guest to Manager. COMPLIANCE WITH REGULATIONS. Guest shall promptly comply with all laws, ordinances, requirements and regulations of the federal, state, county, municipal and other authorities, and the fire insurance underwriters. However, Guest shall not by this provision be required to make alterations to the exterior of the building or alterations of a structural nature. ASSIGNABILITY/SUBLETTING. Guest may not assign or subbooking any interest in the Premises, nor assign, mortgage or pledge this Booking, without the prior written consent of Manager. CASUALTY OR DESTRUCTION. (a) Should the Property be destroyed or rendered uninhabitable by an Act of God (including, but not limited to, hurricanes, storms, floods or fires), or by environmental disaster, or loss of utilities prior to occupancy by Guest, this Agreement shall become null and void, and all payments made hereunder shall be refunded to Guest. (b) Should the Property be destroyed or rendered uninhabitable as above during occupancy, reimbursement on a pro-rated basis will be negotiated between Guest and Manager based on the following: No refund is due (or will be made) for inclement weather. NOTICE. Notices under this Booking shall not be deemed valid unless given or served in writing and forwarded by mail, postage prepaid, addressed to the party at the appropriate address set forth below. Such addresses may be changed from time to time by either party by providing notice as set forth below. Notices mailed in accordance with these provisions shall be deemed received on the third day after posting. This Booking shall be construed in accordance with the laws of the State of Florida. ENTIRE AGREEMENT/AMENDMENT. This Booking contains the entire agreement of the parties and there are no other promises, conditions, understandings or other agreements, whether oral or written, relating to the subject matter of this Booking. This Booking may be modified or amended in writing, if the writing is signed by the party obligated under the amendment. SEVERABILITY. If any portion of this Booking shall be held to be invalid or unenforceable for any reason, the remaining provisions shall continue to be valid and enforceable. If a court finds that any provision of this Booking is invalid or unenforceable, but that by limiting such provision it would become valid and enforceable, then such provision shall be deemed to be written, construed, and enforced as so limited. WAIVER. The failure of either party to enforce any provisions of this Booking shall not be construed as a waiver or limitation of that party's right to subsequently enforce and compel strict compliance with every provision of this Booking. BINDING EFFECT. The provisions of this Booking shall be binding upon and inure to the benefit of both parties and their respective legal representatives, successors and assigns. DISPUTE RESOLUTION. The parties will attempt to resolve any dispute arising out of or relating to this Agreement through friendly negotiations amongst the parties. If the matter is not resolved by negotiation, the parties will resolve the dispute using the below Alternative Dispute Resolution (ADR) procedure. Any controversies or disputes arising out of or relating to this Agreement will be submitted to mediation in accordance with any statutory rules of mediation. If mediation is not successful in resolving the entire dispute or is unavailable, any outstanding issues will be submitted to final and binding arbitration under the rules of the American Arbitration Association. The arbitrator's award will be final, and judgment may be entered upon it by any court having proper jurisdiction. CAUSE FOR EVICTION. The Guest and all parties with the Guest will be subject to immediate eviction from the Property if the Guest or parties of the Guest violate any terms of this Agreement, including but not limited to, violation of the occupancy limits, pet provision, smoking, noise ordinance or parking. In the event of eviction from the Property, the Guest shall forfeit all amounts paid and there will be no refund of money. ATTORNEY'S FEES AND COSTS. If Manager employs the services of an attorney to enforce any conditions of this Agreement, to collect any amounts due, the eviction of the Guest, or because Guest takes any action to recover deposits not due, Guest shall be liable to Manager for reasonable attorney's fees and costs incurred by Manager. Two Stories, LR, Full Dining Room, balconies on both levels, Plenty of room to spend the day inside or outside. The space TheDaytonaPenthouse is an amazing 2 story oceanfront penthouse on the 19th and 20th floors of the desirable Horizons Condo on the ''World's Most Famous Beach. '' Spectacular views from the expansive balconies on both floors. Walking in the front door and the ocean view is right in front of you. We have a full dining room and spacious living room with floor to ceiling windows and sliders. We have a spacious renovated kitchen with center island also with windows and sliders to the balcony. A King size BR and and full bath on the main level for those that prefer no stairs. Wrap around balconies provide some of the most amazing views around. Upstairs you will find two large bedrooms and each with a private baths. One bedroom has 2 queen beds and the master BR has a King with a gorgeous renovated bathroom. A large sundeck and balcony complement the second level rooms. Amenities such as exercise room, sauna, community room, oceanfront pool and barbecue area are included. We provided everything you need for your stay. Beach towels, plenty of bath towels, washer, dryer, a kitchen with all the tools you need if cooking is your desire and that wonderful ocean view that brought you to Daytona Beach. Our HOA is performing exterior maintenance on the entire building - concrete restoration and painting. The workers start around 8am and end at 4pm M-F. You may experience noise throughout the day based on what they are doing or where they are working. Previous guests have not expressed any issues or impacts with their stays. Guest access You are renting our entire Penthouse. You have access to the common pool, sauna and workout room and direct access to the beach. There is a common parking deck for the building and we also have a secure garage parking Other things to note This is our second home. Our building is comprised of residents that are not on vacation and we ask that you adhere to quiet hours of 10pm to 8am and avoid late night or early morning disruptions and noise. Complaints or calls to the police or building management could force eviction. We do maintain a camera that monitors the front door only from inside the unit. Upon request, we can provide access information so that you may also log into camera at anytime during your stay.

In lieu of a security deposit, at the time of the booking, guest shall be required to purchase rental coverage for the duration of their stay. The guest is held financially responsible for damages to the Rental Property, whether made by themselves, their family, and another guest in their group or invitee. POSSESSION. Guest shall be entitled to possession on the first day of the term of the booking at 3pm (condos) 4pm (houses), and shall yield possession to Manager on the last day of the term of this Booking at 10am, unless otherwise agreed by both parties in writing and early check-in or late check-out fee paid. At the expiration of the booking, guest shall remove its goods and effects and peaceably yield up the Premises to manager in as good a condition as when delivered to guest. MINIMUM STAY. The guest will be required to pay for the booked dates. Guests wishing to extend their stay may do so by contacting the Manager and paying additional fees if the unit is available for extension and the guest has abided by all rules. USE OF PREMISES/ABSENCES. Guest shall occupy and use the Premises as a dwelling unit. Guest shall notify Manager of any anticipated extended absence from the Premises not later than the first day of the extended absence. Guest will maintain the premises in good order and appearance including keeping the premises free of trash and garbage. Reasonable wear and tear are the only exceptions to damage to the premises. Booking guest agrees to be the primary occupant of the dwelling during the entire period of the rental. Guest may not use the premise for commercial or event purposes. No commercial photography or filming is allowed on the property. Guests booking units that may allow small weddings or similar must notify Manager upon booking, pay additional fees and disclose all requested information to Manager. In the event a guest hosts an agreed up event but does not give accurate information as to the time of the event, number of guests or type of event, booking will be cancelled and guests immediately evicted. Any agreed upon event must be paid no less than 7 days prior to event. Manager has the right to deny any event request for any reason. Guests may not hang towels over outdoor railings, erect tents or banners or do anything else to make property look less appealing to neighbors. Guest agrees to lock all doors and windows when they are not at the property. Due to the COVID-19 pandemic, Guest agrees to adhere to all guidance from the Centers of Disease Control and Prevention (CDC) on COVID-19 and any local and state regulations. Local and state regulations can be found on the local public health department website. OCCUPANTS. No more than the number of person(s) entered in the booking may occupy the Premises at any one time unless the prior written consent of the Manager is obtained. All guests over the age of 2 are counted towards the maximum. Any party falsely representing the number of people, or exceeding the maximum may be subject to immediate eviction without refund. All guests over the age of 15 will be required to provide a copy of a government issued ID. For properties that allow pets, pets are only allowed if approved by Manager. All pets must be disclosed to Manager within 24 hours of booking, or if booking is less than 24 hours from booking time then at the time of booking. Guest must pay any required pet fees no less than 7 days prior to reservation start. For bookings made within a week of reservation, fee must be paid same day as the reservation is made. Guests must be 25 to book (or the specified minimum age to book as noted on the booking site). Guests under the minimum age must be accompanied by a legal guardian or parent. Guests over 25 may not book a property for the use of a group under the age of 25 (ex: a mom or aunt cannot book a unit for a group of high schoolers where the parent or legal guardian will not be present). FURNISHINGS. The unit is completely furnished and stocked. Guest shall return all such items at the end of the stay in a condition as good as existed at the beginning of the booking, normal wear and tear excepted. PROPERTY INSURANCE. Manager and Guest shall each be responsible to maintain appropriate insurance for their respective interests in the Premises and property located on the Premises. Guest shall also maintain any other insurance which Manager may reasonably require for the protection of Manager's interest in the Premises. Guest is responsible for maintaining casualty insurance on its own property. It is recommended that travel or vacation insurance is obtained by the Guest. Manager requires unit insurance coverage purchase at booking. NON-DISTURBANCE CLAUSE. Guest and their guests shall not disturb, annoy, endanger (fireworks) or inconvenience neighbors nor use the premises for any unlawful purposes. Quiet hours are from 10pm to 8am. Guests shall adhere to noise policy and shall interact kindly with neighbors. Guests understand that many units are in residential areas and will act with the utmost respect while at the premise or in the neighborhood/condo. Guest will not be heard using foul language, being rude, arguing or displaying obvious intoxication. Guest will treat property with the same care as if the property was their home and will not hinder normal traffic patterns in the area. Guests will not do anything neither at the unit nor in the neighborhood/building that would cause complaints from neighbors, HOA or Condo Managers or police/code enforcement. Guest will abide by any parking restrictions. CANCELLATIONS. (a) If the Property becomes unavailable to the Guest prior to occupancy, for any reason, Manager agrees to refund the full amount paid to the date of cancellation, and Guest agrees to rebooking any claims against Manager. (b) Cancellations from guest will be refunded as described on the booking site used by guest. Guest understands that use of OTA’s such as Airbnb frequently require the guest contact the OTA directly as sites like Airbnb hold the guests money and Manager may not have ability to refund. Cancellations related to the COVID-19 pandemic are dependent on a number of factors including: local restrictions, origin of the guest, when the booking was made, and when local officials or the CDC declare an outbreak in an area. If the cancellation is related to COVID-19, please refer to the booking sites policy. SMOKING. Smoking is strictly forbidden inside the Property. Smoking is only allowed "outside". Evidence of smoking inside the Property will result in immediate eviction and forfeiture of all amounts paid and will result in additional Cleaning Fee charges to Guest as Excess Damage Cost and will be charged against the credit card on file. Smoking near open doors and windows that leads to interior smell of smoke will be charged as if guest was smoking in unit. Please note, purchased damage coverage does not cover smoking and guests card on file will be charged $500 for damage and smoke remediation. COOKING. Guest may cook only in the specific areas set aside by Manager for cooking. No open fires are allowed other than in the grill, outdoor fireplace, or in the stone hearth. The grill must remain in open area, away from trees, house, etc. All fires must be thoroughly extinguished before leaving unattended. CLEANING. The property will be inspected and cleaned after departure. Due to the pandemic, the property will augment current cleaning protocol to account for the changes in cleaning in adherence to COVID-19 cleaning protocols. The cleaning fee includes laundry service for the towels and linens. Guest is required to leave the property in the same general condition that it was received in by making sure that the dishes are washed and put away, and the house is generally picked up and ready to be vacuumed, dusted, disinfected and laundered. The property has been cleaned in accordance with WHO and CDC recommended cleaning and disinfecting standards. HOT TUBS & POOLS. For properties with a Hot Tub or Pool, guest acknowledges, and is fully aware that the hot tub and/or pool can be dangerous and slippery. Injury can be caused by careless acts. The undersigned Guest and their visitors accepts and assumes all risks involved in or related to the use of the hot tub and/or pool. No lifeguard on duty pool. Guest will be required to never swim alone and children will always be supervised. Nobody that is unable to swim shall enter the pool or hot tub. No diapers or similar allowed in pool. No glass or food in pool. Glass or food in pool would result in an extra pool cleaning charge to guest. HOLDOVER. If Guest maintains possession of the Premises for any period after the termination of this Booking ("Holdover Period”), Guest shall pay to Manager booking payment(s) during the Holdover Period at a rate equal to the most recent highest-posted rate preceding the Holdover Period. Such holdover shall constitute a month-to-month extension of this Booking. Guest are required to prepay and get reapproval to holdover. CUMULATIVE RIGHTS. The rights of the parties under this Booking are cumulative, and shall not be construed as exclusive unless otherwise required by law. ACCESS BY Manager TO PREMISES. Subject to Guest's consent (which shall not be unreasonably withheld), Manager shall have the right to enter the Premises to make inspections, provide necessary services, or show the unit to prospective buyers, mortgagees, Guests or workers. However, Manager does not assume any liability for the care or supervision of the Premises while under the possession and of Guest. As provided by law, in the case of an emergency, Manager may enter the Premises without Guest's consent. During this Booking, Manager shall be allowed to display the usual "To Let" signs and show the Premises to prospective Guests. INDEMNITY REGARDING USE OF PREMISES. To the extent permitted by law, Guest agrees to indemnify, hold harmless, and defend Manager from and against any and all losses, claims, liabilities, and expenses, including reasonable attorney fees, if any, which Manager may suffer or incur in connection with Guest's possession, use or misuse of the Premises, except Manager's act or negligence. DANGEROUS MATERIALS. Guest shall not keep or have on the Premises any article or thing of a dangerous, flammable, or explosive character that might substantially increase the danger of fire on the Premises, or that might be considered hazardous by a responsible insurance company, unless the prior written consent of Manager is obtained and proof of adequate insurance protection is provided by Guest to Manager. COMPLIANCE WITH REGULATIONS. Guest shall promptly comply with all laws, ordinances, requirements and regulations of the federal, state, county, municipal and other authorities, and the fire insurance underwriters. However, Guest shall not by this provision be required to make alterations to the exterior of the building or alterations of a structural nature. ASSIGNABILITY/SUBLETTING. Guest may not assign or subbooking any interest in the Premises, nor assign, mortgage or pledge this Booking, without the prior written consent of Manager. CASUALTY OR DESTRUCTION. (a) Should the Property be destroyed or rendered uninhabitable by an Act of God (including, but not limited to, hurricanes, storms, floods or fires), or by environmental disaster, or loss of utilities prior to occupancy by Guest, this Agreement shall become null and void, and all payments made hereunder shall be refunded to Guest. (b) Should the Property be destroyed or rendered uninhabitable as above during occupancy, reimbursement on a pro-rated basis will be negotiated between Guest and Manager based on the following: No refund is due (or will be made) for inclement weather. NOTICE. Notices under this Booking shall not be deemed valid unless given or served in writing and forwarded by mail, postage prepaid, addressed to the party at the appropriate address set forth below. Such addresses may be changed from time to time by either party by providing notice as set forth below. Notices mailed in accordance with these provisions shall be deemed received on the third day after posting. Such addresses may be changed from time to time by either party by providing notice as set forth above. GOVERNING LAW. This Booking shall be construed in accordance with the laws of the State of Florida. ENTIRE AGREEMENT/AMENDMENT. This Booking contains the entire agreement of the parties and there are no other promises, conditions, understandings or other agreements, whether oral or written, relating to the subject matter of this Booking. This Booking may be modified or amended in writing, if the writing is signed by the party obligated under the amendment. SEVERABILITY. If any portion of this Booking shall be held to be invalid or unenforceable for any reason, the remaining provisions shall continue to be valid and enforceable. If a court finds that any provision of this Booking is invalid or unenforceable, but that by limiting such provision it would become valid and enforceable, then such provision shall be deemed to be written, construed, and enforced as so limited. WAIVER. The failure of either party to enforce any provisions of this Booking shall not be construed as a waiver or limitation of that party's right to subsequently enforce and compel strict compliance with every provision of this Booking. BINDING EFFECT. The provisions of this Booking shall be binding upon and inure to the benefit of both parties and their respective legal representatives, successors and assigns. DISPUTE RESOLUTION. The parties will attempt to resolve any dispute arising out of or relating to this Agreement through friendly negotiations amongst the parties. If the matter is not resolved by negotiation, the parties will resolve the dispute using the below Alternative Dispute Resolution (ADR) procedure. Any controversies or disputes arising out of or relating to this Agreement will be submitted to mediation in accordance with any statutory rules of mediation. If mediation is not successful in resolving the entire dispute or is unavailable, any outstanding issues will be submitted to final and binding arbitration under the rules of the American Arbitration Association. The arbitrator's award will be final, and judgment may be entered upon it by any court having proper jurisdiction. CAUSE FOR EVICTION. The Guest and all parties with the Guest will be subject to immediate eviction from the Property if the Guest or parties of the Guest violate any terms of this Agreement, including but not limited to, violation of the occupancy limits, pet provision, smoking, noise ordinance or parking. In the event of eviction from the Property, the Guest shall forfeit all amounts paid and there will be no refund of money. ATTORNEY'S FEES AND COSTS. If Manager employs the services of an attorney to enforce any conditions of this Agreement, to collect any amounts due, the eviction of the Guest, or because Guest takes any action to recover deposits not due, Guest shall be liable to Manager for reasonable attorney's fees and costs incurred by Manager. D. Renter must be at least 21 years of age (or the specified minimum age required to rent the property, if different). Guests under the minimum age must be accompanied by a parent or legal guardian.

The Tenants shall maintain the premises in a good, clean, and ready-to-rent condition and use the premises only carefully and lawfully. The tenants shall leave the premises in a ready-to-rent condition at the expiration of the rental agreement, defined by the Landlord as being immediately habitable by the next tenants. Tenants shall pay for maintenance and repairs should the premises be left in a lesser condition. The tenants agree that the Landlord shall deduct the costs of said services from the security deposit before refund if tenants cause damage to the premises or its furnishings. 3. The Tenants shall dispose of all waste material generated during the rental period in a lawful manner 4. The Tenants shall pay for any damage done to the premises over and above normal wear and tear. 5. The Tenants shall not sublet the property. 6. The Tenants shall behave in a civilized manner and shall be good neighbors respecting the rights of the surrounding property owners. The Tenants shall not create noise or disturbances likely to disturb or annoy the surrounding property owners. Creating a disturbance of the above nature shall be grounds for immediate termination of this agreement and Tenants shall then immediately vacate the premises. 7. The Tenants and Tenants Guests shall hereby indemnify and hold harmless TGVR and any of its employees against any claims of personal injury or property damage or loss arising from the use of the premises regardless of the nature of the accident, injury or loss. Tenants expressly recognize that any insurance for property damage or loss which the Landlord may maintain on the property does not cover the personal property of Tenants and that Tenants should purchase their insurance for Tenants and Guests if such coverage is desired. 8. Tenants agree to pay all reasonable costs, attorney fees, and expenses that shall be made or incurred by the Landlord enforcing this agreement. 9. Tenants expressly acknowledge and agree that this Agreement is for transient occupancy of the Property, short term rental, 1 week stay at the most, and that Tenants do not intend to make the property a residence or household. 10. There may occasionally be power outages, plumbing, heating or air issues that are beyond our control. We report outages as each occurs. No refunds or compensation will be given for any outages. 11. There shall be no refunds of rent due to shortened stays or ruined expectations because of weather conditions. 12. There shall be no refunds of rent because of shortened stays or ruined expectations due to work and family emergencies, COVID-19 closures limited hours of operations, or other commitments. 13. It is the tenant's responsibility to learn about safety precautions, warning signs of conditions, and safety procedures concerning swimming in or being around water, animals, machinery, and other potentially hazardous elements. 14. Tenant agrees that Fireworks and other hazardous materials shall not be used in or around the property. 15. Tenant shall use the property for legal purposes only and other use, such as but not limited to, illegal drug use, abuse of any person, harboring fugitives, etc.; shall cause termination of this agreement with no refund of rents or deposits. 16. Tennant is advised that there may be no carbon monoxide detector on the property and accepts the risk involved in not having one. We recommend you bring one as you travel. 17. Tenant shall see to their security while on the property by locking doors, windows, garage doors, etc. when it is prudent to do so. 18. Valuable items left behind by the tenant will not be returned. The Landlord shall not be held liable for the condition of said items. 19. Tenant understands that this is a timeshare at a resort and not wholly owned or operated by TGVR or any of its employees or clients. TGVR is advertising a week for rental that has been reserved and confirmed through a client’s membership or ownership through their timeshare company. 20. Tenant understands that the resort will assign the condo number upon check-in and that the floor number, condo number, and condo view may change at the discretion of the resort. No views or condo assignments are guaranteed unless it is in the title of the listing i.e, Ocean Front 2 Bedroom, Ocean View 1 Bedroom Condo. If there is no view listed in the title of the listing then it is a first come first serve at check-in for views. 21. Tenants understand that occasionally there are unforeseen maintenance issues. As such the Tenant understands that the condo assignment may change due to unforeseen circumstances such as but not limited to; leaks, broken toilets/tubs, broken door locks-window -doors, no heating or air conditioning, etc. The tenant understands that due to availability issues, they may be moved to a lesser condo than originally reserved. This is not common but could occur. 22. Tenant understands that the photos provided are for rental purposes and may not reflect the actual condo being rented. These photos are for a general overview of the property and may contain photos of a condo not being advertised or available. You are guaranteed the Size of condo, number of beds and views in the listing description you reserved. The floors are usually determined at check in. 23. Tenant understands that this is a resort and as such is required to adhere to all policies for that resort. 24. TGVR advises ALL tenants to contact the resort and not TGVR to ensure the sleeping arrangements (Bed sizes and locations) are what they rented.
