Parking Recreational vehicles, boats, and trailers may not be parked in front of the house, except for temporary loading, unloading and cleaning. City Ordinance request. Inspection The City of Palm Coast has the right to reasonable inspect the premises to assure compliance of all City Ordinances. I. AGREEMENT IV. DEFINITIONS You, or (Your family/friends), is the renter of the vacation rental property and includes the renter’s spouse, children and any other person the renter invited on to the vacation rental property during your stay at the vacation rental property. VACATION RENTAL TERMS AND CONDITIONS: POSSESSION. Guest shall be entitled to possession on the first day of the term of the booking at 3pm and shall yield possession to property owner on the last day of the term of this respective booking at 10am, unless otherwise agreed by both parties in writing and early check-in or late check-out fee paid. At the expiration of the booking, guest shall remove its goods and effects and peaceably yield up the residence to the property owner in as good a condition as when delivered to guest. MINIMUM STAY. The guest will be required to pay for the booked dates. Guests wishing to extend their stay may do so by contacting the property owner and paying additional fees if the home is available for extension and the guest has abided by all rules. USE OF PREMISES/ABSENCES. Guest shall occupy and use the premises as a dwelling unit. Guest shall notify the property owner of any anticipated extended absence from the premises not later than the first day of the extended absence. Guest will maintain the premises in good order and appearance including keeping the premises free of trash and garbage. Reasonable wear and tear are the only exceptions to damage to the premises. Booking guest agrees to be the primary occupant of the dwelling during the entire period of the rental. Guest may not use the premise for commercial or event purposes. Due to the COVID-19 pandemic, Guest agrees to adhere to all guidance from the Centers of Disease Control and Prevention (CDC) on COVID-19 and any local and state regulations. Local and state regulations can be found on the local public health department website. OCCUPANTS. No more than the number of person(s) entered in the booking may occupy the Premises at any one time unless the prior written consent of the property owner is obtained. All guests over the age of 2 are counted towards the maximum. Any party falsely representing the number of people or exceeding the maximum may be subject to immediate eviction without refund. All guests over the age of 15 will be required to provide a copy of a government issued ID. All pets must be disclosed to the property owner at time of booking. Guest must pay any required pet fees at time of booking. Guests must be 25 years of age to book this property. Guests under the minimum age must be accompanied by a legal guardian or parent. Guests over 25 may not book a property for the use of a group under the age of 25 (ex: a mom, uncle, or aunt cannot book a unit for a group of high schoolers where the parent or legal guardian will not be present). FURNISHINGS. The unit is completely furnished and stocked. Guest shall return all such items at the end of the stay in a condition as good as existed at the beginning of the booking, normal wear and tear excepted. PROPERTY INSURANCE. Property owner and Guest shall each be responsible to maintain appropriate insurance for their respective interests in the premises and property located on the premises. Guest shall also maintain any other insurance which the property owner may reasonably require for the protection of the property owner’s interest in the Premises. Guest is responsible for maintaining casualty insurance on its own property. It is recommended that travel or vacation insurance is obtained by the Guest. NON-DISTURBANCE CLAUSE. Guest and their guests shall not disturb, annoy, endanger (fireworks) or inconvenience neighbors nor use the premises for any unlawful purposes. Quiet hours are from 10pm to 8am. Guests shall adhere to the noise policy and shall interact kindly with neighbors. Guest will not be heard using foul language, being rude, arguing or displaying obvious intoxication. Guest will treat property with the same care as if the property was their home and will not hinder normal traffic patterns in the area. Guests will not do anything that would cause complaints from neighbors, or police/code enforcement. Parking: Parking is prohibited on the lawn or street at any time and in the first 15 feet from edge of pavement (swale area) between the hours of 1:00 a.m. and 6:00 a.m. CANCELLATIONS. (a) If the Property becomes unavailable to the Guest prior to occupancy, for any reason, the property owner agrees to refund the full amount paid to the date of cancellation, and Guest agrees to rebooking any claims against property owner. (b) Cancellations from guest will be refunded as described on the booking site used by guest. Guest understands that use of OTA’s such as Airbnb frequently require the guest contact the OTA directly as sites like Airbnb hold the guest's money and property owner may not have ability to refund. SMOKING. Smoking is strictly forbidden inside the Property. Smoking is only allowed "outside". Evidence of smoking inside the Property will result in immediate eviction and forfeiture of all amounts paid and will result in additional Cleaning Fee charges to Guest as Excess Damage Cost and will be charged against the credit card on file. Smoking near open doors and windows that leads to interior smell of smoke will be charged as if guest was smoking in unit. Please note, purchased damage coverage does not cover smoking and guests' card on file will be charged $500 for damage and smoke remediation. COOKING. Guest may cook only in the specific areas set aside by the property owner for cooking. No open fires are allowed other than in the grill. The grill must remain in open area, away from trees, house, etc. All fires must be thoroughly extinguished before leaving unattended. CLEANING. The property will be inspected and cleaned after departure. The cleaning fee includes laundry service for the towels and linens. Guest is required to leave the property in the same general condition that it was received in by making sure that the dishes are washed and put away, and the house is generally picked up and ready to be vacuumed, dusted, disinfected and laundered. HOLDOVER. If Guest maintains possession of the Premises for any period after the termination of this Booking ("Holdover Period”), Guest shall pay to the property owner booking payment(s) during the Holdover Period at a rate equal to the most recent highest-posted rate preceding the Holdover Period. Such holdover shall constitute a month-to-month extension of this Booking. Guest are required to prepay and get reapproval to holdover. CUMULATIVE RIGHTS. The rights of the parties under this Booking are cumulative, and shall not be construed as exclusive unless otherwise required by law. ACCESS BY PROPERTY OWNER TO PREMISES. Subject to Guest's consent (which shall not be unreasonably withheld), property owner shall have the right to enter the premises to make inspections, provide necessary services, or show the unit to prospective buyers, mortgagees, guests or workers. However, property owner does not assume any liability for the care or supervision of the premises while under the possession of guest. As provided by law, in the case of an emergency, property owner may enter the premises without guest's consent. INDEMNITY REGARDING USE OF PREMISES. To the extent permitted by law, guest agrees to indemnify, hold harmless, and defend property owner from and against any and all losses, claims, liabilities, and expenses, including reasonable attorney fees, if any, which the property owner may suffer or incur in connection with guest's possession, use or misuse of the premises, except property owner’s act or negligence. DANGEROUS MATERIALS. Guest shall not keep or have on the premises any article or thing of a dangerous, flammable, or explosive character that might substantially increase the danger of fire on the premises, or that might be considered hazardous by a responsible insurance company. COMPLIANCE WITH REGULATIONS. Guest shall promptly comply with all laws, ordinances (Section 35-53, Sound Level Limits), requirements and regulations of the federal, state, county, municipal and other authorities, and the fire insurance underwriters. However, Guest shall not by this provision be required to make alterations to the exterior of the building or alterations of a structural nature. ASSIGNABILITY/SUBLETTING. Guest may not assign or sub-booking any interest in the premises, nor assign, mortgage or pledge this booking, without the prior written consent of the property owner. CASUALTY OR DESTRUCTION. (a) Should the Property be destroyed or rendered uninhabitable by an Act of God (including, but not limited to, hurricanes, storms, floods or fires), or by environmental disaster, or loss of utilities prior to occupancy by Guest, this Agreement shall become null and void, and all payments made hereunder shall be refunded to Guest. (b) Should the Property be destroyed or rendered uninhabitable as above during occupancy, reimbursement on a pro-rated basis will be negotiated between Guest and Manager based on the following: No refund is due (or will be made) for inclement weather. ENTIRE AGREEMENT/AMENDMENT. This Booking contains the entire agreement of the parties and there are no other promises, conditions, understandings or other agreements, whether oral or written, relating to the subject matter of this booking. This booking may be modified or amended in writing, if the writing is signed by the party obligated under the amendment. SEVERABILITY. If any portion of this Booking shall be held to be invalid or unenforceable for any reason, the remaining provisions shall continue to be valid and enforceable. If a court finds that any provision of this booking is invalid or unenforceable, but that by limiting such provision it would become valid and enforceable, then such provision shall be deemed to be written, construed, and enforced as so limited. WAIVER. The failure of either party to enforce any provisions of this booking shall not be construed as a waiver or limitation of that party's right to subsequently enforce and compel strict compliance with every provision of this Booking. BINDING EFFECT. The provisions of this Booking shall be binding upon and inure to the benefit of both parties and their respective legal representatives, successors and assigns. DISPUTE RESOLUTION. The parties will attempt to resolve any dispute arising out of or relating to this Agreement through friendly negotiations amongst the parties. If the matter is not resolved by negotiation, the parties will resolve the dispute using the below Alternative Dispute Resolution (ADR) procedure. Any controversies or disputes arising out of or relating to this Agreement will be submitted to mediation in accordance with any statutory rules of mediation. If mediation is not successful in resolving the entire dispute or is unavailable, any outstanding issues will be submitted to final and binding arbitration under the rules of the American Arbitration Association. The arbitrator's award will be final, and judgment may be entered upon it by any court having proper jurisdiction. CAUSE FOR EVICTION. The Guest and all parties with the Guest will be subject to immediate eviction from the property if the guest or parties of the guest violate any terms of this Agreement, including but not limited to, violation of the occupancy limits, pet provision, smoking, noise ordinance or parking. In the event of eviction from the property, the guest shall forfeit all amounts paid and there will be no refund of money. ATTORNEY'S FEES AND COSTS. If the property owner employs the services of an attorney to enforce any conditions of this Agreement, to collect any amounts due, the eviction of the guest, or because guest takes any action to recover deposits not due, guest shall be liable to the property owner for reasonable attorney's fees and costs incurred by the property owner. D. Renter must be at least 25 years of age (or the specified minimum age required to rent the property, if different). Guests under the minimum age must be accompanied by a parent or legal guardian. If you are gonna swim in the saltwater canal do so with care and water shoes there’s lots of oysters. The ladder is located by the boat lift.. please lower and raise the ladder after use. The back patio has a Weber grill ready for use ( cannot guarantee there will be fuel) . Enjoy meals on the deck at the outside table that seats 6. There is 2 sun loungers on the dock ready for you to soak up the sun. . Preferably if you have a trailer of any sort, please store it at the marina. The non-refundable deposit is $100. We do not accept cats as the owners are allergic. If the pet fee is not on the initial invoice, the fee will be requested by the owners after the home is reserved. Other things to note Your vacation home will have basic starter supplies for your arrival. This includes toilet paper, bath soap (small hotel size). Also included are bath towels, hand towels, washcloths, linens, a hairdryer, an iron, an ironing board. We stock the house with toilet paper (1-2 rolls per bathroom) and one roll of paper towels.
