Vacation should be fun…but not at the expense of someone getting hurt. Please ask children not to run/jump on stairs, chairs, furniture and beds. Falls and bumped heads or other injuries can happen accidentally and quickly! Do not push, pull, climb, jump, to hang on the railing overlooking the pool (or allow your children to). Excessive force or impact (i.e. roughhousing on the landing and crashing into it) could break it and lead to an injury. No loud parties. This is a quiet neighborhood. Our neighbors around us live here full time, please be respectful. You can park a maximum of 4 cars on the property. Cars may not be parked on any grass/rock areas or on the street. Trailers and motorhomes are strictly prohibited by local ordinance. There is room to park 2 cars in the garage. There is plenty of space for parking in our driveway as well. Please do not park on the neighbor’s drive or in the street. Trash pick-up is every Wednesday morning. Please do not try to break into or force open locked closets, cabinets or drawers. Most of the house is available for our use but a few closets, cabinets and drawers are reserved for storage or our personal items. Please respect our privacy. On all of the glass doors there are white locks. Please do not touch them. They should be always be in the straight up and down position. Please use coasters on all wood furniture. No glassware by the pool please, there is plenty of pool friendly items to use by the pool side. You are responsible for any damaged or lost items.

Test-Ride/Inspect: Renter acknowledges that he/she was instructed to inspect and test-ride the bike or kayak. If there is a problem with the bike or kayak, then Renter must notify the property owner of the problem in writing, have the problem corrected and Renter must not operate the bike or kayak without correcting the problem. By signing this document Renter confirms that the bike/kayak is safe and working as it should. More specifically, Renter acknowledges that the bike/kayak's frame, brakes, wheels, quick releases, and nuts are secure and working properly. No Insurance. Renter acknowledges that the property owners maintain no medical, collision or liability insurance to cover the cost of any injury or damage arising from use of the bike or kayak. Operator Error/Damage and Repair of Bike/kayak. Renter agrees to return the bike/kayak in the same condition as when it was rented. Damage to the bike/kayak caused by any kind of impact will be the responsibility of the Renter. The property owners will not absorb the cost for repairs caused by operator error. Therefore, Renter authorizes the property owners to charge for the reasonable cost of making repairs caused by operator error. Bike/Kayak Theft/Faulty Lock-Up: If the rental bike is stolen, Renter authorizes the property owners to charge for the full retail price of the bike/kayak so that the property owners can immediately replace it by purchasing the same or similar bike. Indemnification Understanding. If Renter is injured on their bike ride/kayak, and Renter's insurance policy pays Renter's hospital/medical/rescue expenses, Renter understands that an agreement between Renter and their insurance company permitting the insurance company to recover paid medical expenses (subrogation) will not defeat or take priority over this agreement. Likewise, if Renter has no medical insurance, Renter will stand between (indemnify) and defend the property owners from any claim made by a hospital. Invalid/Severance Clause: If any category, clause, or provision of this agreement is declared to be void or unenforceable, the property owners and Renter agree that the remainder of the Agreement must remain valid and enforceable. Florida Law: This Agreement is controlled by Florida law. A person or entity attempting to enforce or invalidate any portion of this Agreement, must litigate under Florida law. Attorney’s Fees: If Renter fails to honor any one or more of the clauses or provisions of this Agreement, or if Renter tries to circumvent this Agreement and brings legal action against the property owners, the property owners’ attorney fees for successfully defending this Agreement will be paid by Renter.
