Do you own a place in Positano and you're weighing whether to put it on Airbnb or Vrbo? Well, the good news is that you can, and the Comune itself will barely stand in your way. Positano sits on the Amalfi Coast, in the Provincia di Salerno in Campania, and it runs no cap on short lets, no ban, no licence, no zoning line drawn around the centro storico and no minimum stay. Not many famous Italian tourist towns can still say all of that in 2026.
The catch sits above the Comune rather than inside it. Italy's 2026 budget law cut the number of apartments one person can short-let before the law treats the whole operation as a business, and it cut it from four to two. Campania then stacks its own registration code on top of the national one, so a Positano listing carries two identifiers instead of one. And because the Comune has never signed a collection deal with Airbnb, you take the tourist tax off your guests yourself and hand it over every month on an F24. Get any of that wrong and the fines start at €500 and run to €10,000.
So let's walk through what it actually takes to do this properly: the filing that starts the activity, the two codes you have to display, the safety kit inspectors look for, every layer of tax and who remits it, and how hard any of it gets enforced on this stretch of coast. Everything below comes from the Comune di Positano's own pages, Regione Campania's own forms and the national ministries, read in July 2026. What are Short-Term Rental (Airbnb, VRBO) Regulations in Positano, Italy?
Three layers of law stack up here, and reading only one of them is how most owners get this wrong.
The bottom layer is national, and it defines what you're doing. A locazione breve is a residential lease of no more than 30 days between private individuals acting outside a business, and the Agenzia delle Entrate's April 2026 guide to short lets sets out where the boundary sits. Contracts of 30 days or less need no registration at all.
You can bundle in linen, cleaning, wi-fi and the phone line without changing anything. Serve breakfast, though, or supply meals, hire cars, guides or interpreters, and the whole thing turns into a business activity in the tax sense, "anche se svolta in maniera occasionale", even where you only did it once.
The middle layer is Campania, and it's the one owners arriving from a Google search usually haven't heard of. Regional Law 11 of 5 July 2023, published on BURC n. 50 and in force from 6 July 2023, rewrote article 13 of L.R. 16/2019 and pulled short lets into the same regime as guesthouses.
Before you start, comma 5-quater requires you to tell the Comune your cadastral data, the address, the number of rooms and bed places, your own name, codice fiscale, phone and email, and to declare that the property meets hygiene and safety rules. Skip that notification and comma 5-quinquies lets the Comune fine you €500 to €2,000. That same law also deleted the old three-night minimum stay for holiday apartments, which is why a one-night booking is legal in Positano today.
The top layer is Positano itself, and it's thin by design. Going through the Comune's published material, the only short-let rules it has written for itself are fiscal and statistical: a tourist tax regolamento approved by Consiglio Comunale deliberation n. 37 of 29 December 2017 and amended by DCC n. 20 of 30 September 2020, plus two standing notices from the Ufficio del Commercio and the Ufficio Tributi. There's no register of permitted units, no annual quota and no restriction by street or building.
Two identifiers hang off all of this, and you need both:
- The CUSR, Campania's Codice Unico Strutture Ricettive. Campania's SURAP portal confirms that short lets do get a CUSR under article 13 of L.R. 16/2019. Your Comune generates and assigns it through the region's Sinfonia Turismo Smart system, and you must use it in all marketing, communication and promotion.
- The CIN, the national Codice Identificativo Nazionale created by article 13-ter of DL 145/2023. You request it from the Ministero del Turismo's accommodation database once you hold the regional code.
Neither one is a permission. They're identifiers, which is what makes them dangerous to skip: a code missing from a listing is visible to anyone with a browser, including the officers whose job it is to look.
Starting a Short-Term Rental Business in Positano
Since nothing in Positano limits how many units exist, the ceiling that matters is still the one in the tax code, and that ceiling moved on 1 January 2026. It's the single most important change for anyone who bought here between 2020 and 2024 on the old arithmetic.
Until 31 December 2025 you could put four apartments into short letting and stay a private landlord. From 2026, article 1 comma 17 of Legge 199/2025 allows the short-let regime only where no more than two apartments are let per tax period. Past that, in the Agenzia delle Entrate's own words, "l'attività di locazione breve, da chiunque esercitata, si presume svolta in forma imprenditoriale". The presumption isn't rebuttable by being small or being careful, and it doesn't care whether you call yourself an investor.
Two is the number to plan around now.
Campania has already rebuilt its paperwork around the new number, which is what makes this administrative rather than merely fiscal. The Region's own standardised communication form for non-entrepreneurial short lets now carries the rule in its operative text.
Once you've already started two short or tourist lettings in your own name, whether or not either was entrepreneurial, starting a third triggers the presumption of business activity for all of them. You then don't file the ordinary communication at all. You file a SCIA for the third activity and a separate SCIA for each non-entrepreneurial letting already running, after which fresh CUSR codes are issued and each of those needs a fresh CIN.
One thing is worth flagging, since the paperwork and the statute have drifted apart. Campania's L.R. 11/2023 still says in comma 5-bis that short letting becomes entrepreneurial above "più di quattro unità immobiliari", four units.
Regione Campania's forms, updated for the 2026 budget law and republished under Decreto Dirigenziale n. 5 of 25 March 2025, tell you to file the SCIA at the third. The form is what your Comune actually processes, so treat two as your working limit and don't let a stale statute quotation talk you into a third apartment.
Two structural facts shape the business case here more than any rule does. First, you don't have to own the flat: the regional form lets you file as owner, tenant, sub-tenant or borrower under a comodato.
Second, the demand is real and the Comune measures it precisely, because the tourist tax runs through its books. ANSA reported in August 2024 that Positano collected more than €2,419,000 in tourist tax during 2023, worth €614 for every one of its 3,942 residents. That put it ninth in Italy per head and first in Campania. A town of under 4,000 people taxes visitors like a small city.
Short-Term Rental Licensing Requirement in Positano
Given that ceiling, the encouraging part is that clearing the first two units still takes no licence whatsoever. Positano issues no permit for a short let, holds no hearing, and publishes no fee for the filing. What it takes instead is a communication, in a fixed regional format, sent by certified email.
The form to use is Campania's, not Positano's own invention. Positano's Ufficio del Commercio published a notice on 3 April 2025 confirming that Decreto Dirigenziale n. 5 of 25/03/2025, on BURC n. 18 of 31/03/2025, approved four standardised modules for comuni to use: a SCIA for entrepreneurial letting, a variation notice for accommodation structures, a start-up communication for non-entrepreneurial letting, and a variation notice for that. The notice then points you at SURAP's download page, which is where the current files live.
The sequence itself is short, though each step gates the next:
- File the communication with the Comune di Positano, sent only to its PEC address. Even if you send it from an ordinary mailbox, it has to arrive at the certified one.
- Receive your CUSR from the Comune, generated through Sinfonia Turismo Smart.
- Request your CIN on the Ministero del Turismo's BDSR portal, logging in with SPID or CIE. The ministry's own BDSR guidance gives you 30 days from the assignment of the regional code, and where a region issues no code you request the CIN at start-up instead.
- Display both codes. The CIN goes on the outside of the building, subject to urban and landscape constraints, and into every advertisement wherever it's published. Be aware that intermediaries and platforms have to carry it in the listing too. The CUSR goes into all your marketing under article 13 of L.R. 16/2019.
Fit the safety equipment before you take a booking rather than after, because this gets checked on inspection and the standard is specific. Every short let, entrepreneurial or not, needs working combustible gas and carbon monoxide detectors and portable extinguishers rated at least 13A with a charge of at least 6 kg or 6 litres. You need one per 200 square metres or fraction of it, with a minimum of one per floor, sited visibly and accessibly near the exits.
The penalty schedule under article 13-ter comma 9 of DL 145/2023 is where the cost of ignoring any of this turns concrete:

That last row is Campania's, imposed by the Comune rather than the state, and it's the one people forget. Remember that the regional and national obligations run in parallel: a CIN in your listing doesn't cure a communication you never sent to Positano.
Required Documents for Positano Short-Term Rentals
Nothing on that list is hard to satisfy, yet the communication itself asks for far more detail than most owners expect, so gather the property paperwork before you open the form. Campania's non-entrepreneurial start-up module wants your flat described the way a surveyor would describe it, not the way a listing does.
- Your identity and standing. Name, place and date of birth, codice fiscale, residence, phone, email and any PEC, plus a tick confirming whether you're the owner or a tenant, sub-tenant or comodatario.
- The address in full. Street and number, floor, staircase and internal number, comune, CAP and provincia.
- Cadastral identifiers. Sezione, foglio, particella, sub where one exists, and the categoria catastale.
- ISTAT codes. Codes for the comune, the provincia and the regione, plus the national classification codes C, C2 and C204 that mark the unit as a short let.
- Measurements and capacity. Total usable floor area, the number of rooms, bathrooms and total bed places, and the square metres of each individual guest room.
- Commercial detail. The period of availability and the trading name you'll use for the activity.
- Every other letting you already run. A table listing each one with its CUSR and its CIN, or a plain "0" if this is your first.
Then come the declarations, made under article 76 of DPR 445/2000, which makes a false statement a criminal matter rather than an administrative one. You declare that the property complies with urbanistic, building, hygiene-sanitary and safety rules for ordinary dwellings, and that you've met the specific safety requirements of article 13-ter comma 7 of DL 145/2023.
You also acknowledge, in the form's own text, four continuing duties: guest reporting to public security, the tourist-tax declaration, ISTAT movement data under L.R. 16/2019, and prompt notice to the SUAP of any suspension, cessation or change.
Only two attachments go with it. A photocopy of a valid identity document, which you can skip if you sign digitally, and a floor plan at a scale of at least 1:50. That plan is the one item most people don't have lying around, so do check with your geometra early if the flat has been altered since the last cadastral update.
Positano Short-Term Rental Taxes
Assuming you get the filing accepted and are able to start taking bookings, there's still tax to sort out, and in Positano it arrives from three directions at once. One layer is the Comune's, one is the state's, and one is handled by whoever processes the money.

The tourist tax is the one that generates daily work. Positano's imposta di soggiorno service page confirms that Giunta Comunale deliberation n. 181 of 19 November 2025, published on 9 February 2026, held the existing rates for stays between 1 April and 31 October 2026.
Short lets sit in the €2.50 band alongside one and two-star hotels, B&Bs, agriturismi and holiday apartments, and the page names "gli immobili destinati alla locazione breve" explicitly, so there's no argument to be had about whether an Airbnb counts. Outside that seven-month window no tax is due at all. Children up to their tenth year are exempt where the guest documents it, and the Comune states flatly that "non sono previste riduzioni", no reductions of any kind.
Now, the collection mechanics. You have to request credentials and register each of your properties in the tourist-tax portal the Comune provides, then upload simple monthly totals of taxed and exempt guests and nights.
The portal produces your F24, and payment is due by the 16th of the following month under the "IMU e altri tributi locali" section, using codice tributo 3936 and Positano's codice catastale G932. Keep in mind that there's no minimum amount below which the tax isn't owed, so a single night in October still generates a filing.
Do not assume your platform is handling this. In a notice to hosts, the Ufficio Tributi states that the Comune di Positano "non ha aderito ad alcun accordo" with Airbnb for managing the tourist tax, so the tax "dovrà essere riscossa da ciascun gestore e riversata al Comune". That is unusual enough to be worth reading twice. In plenty of Italian towns the platform withholds and remits; in Positano you charge the guest, issue a numbered and named receipt, keep a copy, and pay the Comune yourself.
It's a monthly job, not a setup task.
The annual side is heavier than the monthly one. A cumulative declaration goes in telematically by 30 June of the year following, through the Agenzia delle Entrate's Entratel or Fisconline channels, in the model approved by the MEF decree of 29 April 2022. For an omitted or untruthful declaration, article 180 of DL 34/2020 sets a penalty of 100% to 200% of the amount due.
And the status you take on is not a light one. Collecting the tax makes you an agente contabile, subject to the jurisdiction of the Corte dei conti and required to render a conto giudiziale under article 93 of D.Lgs. 267/2000. Keep every receipt, invoice and exemption document for five years. Don't forget the publicity duty either, since the Comune requires the tax to be disclosed on notice inside the property and on every channel you advertise through, websites and online platforms included.
Income tax is simpler, at least by comparison. Since 1 January 2024 the cedolare secca on short lets has been 26%, reduced to 21% for income from one property per tax period, which you nominate in your return. The substitute tax applies to the whole contract amount, with none of the 5% forfait abatement that ordinary rentals get.
Where an intermediary or portal collects your money it must operate a 21% withholding on account on the gross, pay it on F24 with codice tributo 1919, and report your contract data, including your CIN, by 30 June of the following year. Omitted, incomplete or untruthful reporting costs the intermediary €250 to €2,000, halved if fixed within 15 days. Positano Wide Short-Term Rental Rules
Tax is only half of what a Positano host owes each month, because the same booking also generates two separate reporting duties, and both of them have teeth.
The first is public security. Under article 109 of the TULPS and the ministerial decree of 7 January 2013, guest identity data goes to the territorially competent Questura through the Servizio Alloggiati portal within 24 hours of arrival. Where the stay is shorter than a day, it goes at the moment of arrival itself. There's no alternative channel; the police portal is the only route.
How you take that identification has changed, and it caught a lot of remote hosts out. In November 2025 the Consiglio di Stato overturned the TAR Lazio decision that had suspended the Interior Ministry's circular on guest identification, restoring the requirement that a manager verify in person the match between the document holder and the person actually staying.
ANSA reported the ruling on 21 November 2025, quoting the obligation to check "la corrispondenza tra il titolare del documento e l'effettivo ospite della struttura". A key box with a code sent by message no longer satisfies that on its own. So if you've been running Positano remotely from Naples or from abroad, budget for someone local to meet guests.
The second duty is statistical, and Positano has just put its hosts on notice about it. Article 13 comma 5 of L.R. 16/2019 requires monthly reporting of tourist movements, with daily detail, through Campania's Rilevatore Turistico Regionale, currently the Sinfonia Turismo SMART platform. That feeds ISTAT under EU Regulation 692/2011.
In a notice dated 25 February 2026, the Ufficio del Commercio passed on Regione Campania's finding, in note Prot. n. 0057748/2026 of 23 January 2026, that checks on the regional portal showed "per la maggior parte le strutture ricettive ubicate in codesto Comune non assolvono all'obbligo".
Most accommodation businesses in Positano weren't filing. The notice extends the duty expressly to "le attività di locazione breve" and warns that non-compliance draws an administrative fine imposed by the Comune itself.
Two things above the Comune are worth watching in 2026, because both could change what Positano is allowed to do.
EU-wide data sharing starts this year. Regulation (EU) 2024/1028 on data collection and sharing for short-term rentals was adopted on 11 April 2024, and article 19 says plainly that it "shall apply from 20 May 2026". Platforms will transmit activity data monthly to national entry points: nights let, guests per night, the registration number and the listing URL. Italy already has the CIN, so the plumbing exists.
Italian comuni have just been told they can limit short lets. In sentenza 186, deposited on 16 December 2025, the Corte costituzionale rejected the government's challenge to Tuscany's tourism law. Article 59 of that law lets comuni with high tourist density and provincial capitals mark out zones where specific criteria and limits apply to short letting, and make the activity conditional on a five-year authorisation per unit. The Court held that this belongs to territorial governance and tourism rather than civil law.
Campania has passed no equivalent, and Positano has adopted no such regulation, so nothing has changed on the ground here. Still, the constitutional route to a cap is now open, and that's new since 2024.
Does Positano Strictly Enforce STR Rules?
Positano's own enforcement is quiet, but the agencies operating above it on this coast are not, and 2026 has been the busiest year yet.
The clearest signal came in June 2026. The Guardia di Finanza's Comando Provinciale di Salerno ran more than 60 inspections of tourist accommodation across the Costiera Amalfitana and Cilento, and more than half of the checks ended in findings of irregularity.
As reported, the operation turned up over €9.5 million in undeclared income, roughly €12 million of IRAP base and over €600,000 of unpaid VAT. The violations named are precisely the ones this guide has been walking through: operators unknown to the tax authorities, guest data never sent to public security, undeclared workers, and unpaid local tourist tax.
The trade body's reaction says something about where the pressure comes from. ABBAC's president Agostino Ingenito welcomed the controls in a statement on 12 June 2026, calling abusivism and evasion a direct harm to operators who comply, offering free help to anyone wanting to regularise, and encouraging people to report irregular practices. When the association representing extra-hotel operators is asking for more inspections, the complaint-driven enforcement most cities rely on has effectively been outsourced to your competitors.
At the municipal level, Positano works by verification rather than patrol. Under article 13 comma 5-quater lett. b) of L.R. 16/2019, which you acknowledge in the communication form itself, the Comune may at any moment check that the declared requirements exist, that your certifications are truthful and that the operating conditions hold, and you must make the property available for those checks. Add the February 2026 notice about unfiled movement data, which reads as a warning shot rather than a reminder, and it's reasonable to expect fines to follow.
What changes the odds most, though, is that the paperwork now cross-references itself. Your intermediary reports your contract data with your CIN attached to the Agenzia delle Entrate every June. Your CIN traces back through your CUSR to the communication you filed with Positano. From 20 May 2026 the platform also reports your nights and guest counts under the EU regulation. Nobody has to knock on a door to notice that a flat advertising a full season is declaring six weeks.
How to Start a Short-Term Rental Business in Positano
Given how much of that cross-checking now happens automatically, doing the steps in order matters more than doing them quickly. Each one produces something the next one needs.
- Count your existing lettings first. If you already run two short or tourist lets in your own name, a third turns all of them into a business under Legge 199/2025, and the route becomes SCIAs and new codes rather than a simple communication.
- Check the flat against the declarations you'll be signing. Urbanistic, building, hygiene-sanitary and safety compliance for a normal dwelling, and a current floor plan at 1:50. Fix any cadastral mismatch before you file, not after.
- Fit the safety kit. Gas and carbon monoxide detectors that work, plus 13A extinguishers of at least 6 kg or 6 litres, one per 200 square metres and at least one per floor.
- Download the current Campania form for non-entrepreneurial short letting from SURAP, or the SCIA if you're operating as a business, and fill in the cadastral, ISTAT, area and capacity detail in full.
- Send it to the Comune's PEC at [email protected], with your ID copy attached unless you've signed digitally.
- Collect your CUSR from the Comune, then request your CIN on the BDSR portal within 30 days of that regional code landing.
- Put both codes where they belong. CIN outside the building and in every advertisement, CUSR in all marketing. This is the cheapest fine to avoid and the easiest one to earn.
- Register for the tourist tax with the Ufficio Tributi, request portal credentials, and make sure you diarise the 16th of every month along with the 30 June annual declaration.
- Set up your two reporting routines before the first guest: Alloggiati Web within 24 hours of arrival, and the monthly movement return on Sinfonia Turismo SMART with daily detail.
- Arrange in-person check-in. Since November 2025 somebody has to physically match the guest to the document, so line up a keyholder if you're not there yourself.

Whichever of those steps stalls, four offices cover the whole chain between them, and picking the right one first saves a genuinely irritating amount of time. Positano's counter hours are narrow, so watch out for the half-days before you travel.

One gap you should know about before you call. Positano publishes no fee for the short-let communication anywhere I could find, and its only published schedule of diritti di segreteria covers building and planning applications. Ask the Ufficio del Commercio to confirm rather than assuming a neighbouring comune's figure applies.
What Do Airbnb Hosts in Positano on Reddit and Bigger Pockets Think about Local Regulations?
Since enforcement is what most owners want a second opinion on, it's worth being straight about what I could and couldn't read here. Reddit blocks automated access and its platform terms don't permit the commercial data use a guide like this would require, so nothing below is a survey of threads, and I've attributed no view to a forum I didn't open. What follows is my read of the public record I could source.
- Nobody local is arguing that the rules go unenforced. The trade association representing extra-hotel operators in Campania publicly welcomed the June 2026 Guardia di Finanza sweep and asked people to report irregular practices. That's not the posture of a sector that thinks inspections are theatre.
- The compliance gap is administrative, not ideological. Positano's own February 2026 notice found most local structures failing a duty that costs nothing and takes minutes a month. Nobody skips ISTAT reporting out of principle; they skip it because it isn't the tax, isn't the guest and doesn't send a bill until it does.
- The self check-in ruling has been the loudest change for remote owners. Between November 2025 and the 2026 season, an operating model built on key boxes and message codes stopped being compliant. That hits absentee owners hardest and barely touches a family running one flat below their own.
- Positano rarely surfaces on the big US investor forums, and the reason is straightforward. Entry prices on this coast rule out the leveraged single-family strategy those communities are built around, so the conversation about Italy tends to happen among owners of inherited or second homes rather than acquirers.
The pattern I'd take from all of that is a market where the rules are mild but the record-keeping is relentless. Positano asks for less permission than almost any comparable destination and more monthly paperwork than most, which suits an owner with a local contact and punishes one without.

Article 1 comma 17 of Legge 199/2025 cut the ceiling from four apartments to two, and beyond that threshold the law presumes the letting is being carried on in business form, whoever is doing it. In Campania, starting a third activity means filing a SCIA for that one and for every non-entrepreneurial letting already running, after which new CUSR codes are issued and each requires a new CIN.
What are the fines for a short-term rental without a CIN in Positano?
Operating without a CIN draws €800 to €8,000 under article 13-ter comma 9 of DL 145/2023. Failing to display or indicate the CIN costs €500 to €5,000 per structure. Missing gas or carbon monoxide detectors or fire extinguishers costs €600 to €6,000, and running an entrepreneurial letting without a SCIA costs €2,000 to €10,000. Separately, Campania's L.R. 16/2019 lets the Comune fine €500 to €2,000 for failing to notify it before starting.
Can you still use self check-in for a short-term rental in Italy?
Not on its own. In November 2025 the Consiglio di Stato overturned the ruling that had suspended the Interior Ministry's circular on guest identification, restoring the requirement that the operator verify in person that the person entering matches the identity document provided. A key box opened with a code sent by message no longer satisfies that. Guest data still has to reach the competent Questura through the Alloggiati Web portal within 24 hours of arrival, or at arrival for stays under a day.
